Photography usage rights and buyouts made simple

Photography usage rights set how a brand may use images of a person after the shoot. They cover four things: media (where), territory (which countries), term (how long) and exclusivity (whether the talent can work for rivals). The fee for those rights is the buyout. On ShootModel you choose them in checkout.

Media, territory, term and exclusivity

Every usage deal answers the same four questions. The wider the answer, the higher the buyout tends to be, because the talent's face reaches more people for longer.

Media

The question it answers
Where will the images appear
Common choices
Website and e-commerce, organic social, paid social and search ads, email, print, out of home, TV and streaming, packaging

Territory

The question it answers
In which countries or regions
Common choices
One country, a region such as North America or the EU, worldwide

Term

The question it answers
For how long
Common choices
6 months, 12 months, 24 months, longer terms

Exclusivity

The question it answers
Can the talent work for competitors
Common choices
None, or exclusive in one product category for the term

Media is the biggest lever

Using a photo on your own product page is not the same as putting it on a billboard. Paid ads, TV and packaging reach far more people than an organic post, so they cost more to license. Be honest about the media you need, and you will not pay for reach you never use.

Exclusivity keeps rivals away

Exclusivity stops the talent from appearing for a competing brand in the same category during the term. It limits the talent's other work, so it usually adds the most to a buyout. Use it when the person becomes the face of a launch or a long campaign.

The fee for the rights, apart from the shoot time

The talent rate pays for time on set. The buyout pays for using the result. Keeping them apart makes pricing clear. Two shoots with the same hours can have very different totals because one is for a product page and the other is for a national TV spot.

  • 01The rate covers hours on set, from call time to wrap
  • 02The buyout covers the agreed use of the images after the shoot
  • 03A narrow use can have a small buyout or none at all
  • 04A wide, long or exclusive use has a larger buyout

Full buyout

A full buyout gives broad use in all listed media, worldwide, for a long term. It is the most costly option. Many brands find that a defined 12 month deal, renewed when needed, costs less over time.

03

Pick it once, and it goes into every document

When you book on ShootModel, checkout asks you to choose media, territory, term and exclusivity. The buyout for that choice is added to the rate, and you see the full total before you pay. Model Pro talent can set their own buyout price list, which is used when you pick their profile.

After booking, your choices are written into the usage license and the model release, so the documents match what you paid for. Both sides e-sign, and the PDFs stay with the booking.

How the math works for a typical e-commerce shoot

This is an illustration of how the numbers add up in checkout. It is not a market statistic, and real rates and buyouts differ by talent, city and use.

A brand books a model for a 4 hour product shoot. The model's rate for 4 hours is $480. The brand wants to use the images on its website and on organic and paid social in the United States for 12 months, non-exclusive. The buyout for that use is $360.

LineAmount
Talent rate for 4 hours $480
Usage buyout, US web and social, 12 months, non-exclusive $360
Booker service fee None
Total paid by the brand $840

The 15% platform fee is calculated on the talent rate and taken from the talent payout, so in this case $72 comes out of the talent side. It is never added to the brand's total. The brand pays $840, and that is the whole bill.

05

When the term ends

When the term runs out, the brand should stop new uses of the images in the licensed media, unless the rights are renewed. Posts that are already published may be handled differently by different agreements, so check the license text.

Extending or widening the use

To keep using the images, or to add a new medium like print, agree on an extension with the talent before the term ends. Use the booking chat to ask, settle the new term and fee, and put it in writing. It is easiest to plan ahead, so set a reminder a month before the end date.

  • 01Renew the same use for another term
  • 02Add new media, such as adding paid ads to a web-only license
  • 03Add new territories for a launch in another country
  • 04Add exclusivity for a bigger campaign

FAQ

01

What are photography usage rights?

They are the terms that say in which media, in which countries, for how long and how exclusively a brand may use photos or video of a person.

02

What does a buyout mean in modeling?

It is the fee paid to the talent for using the images in the agreed way, on top of the rate for time on set.

03

Do I always need to pay a buyout?

Not always. A narrow use, such as one product page, may have a small buyout or none. Wider uses usually have one.

04

Where do I choose usage on ShootModel?

In checkout. You pick media, territory, term and exclusivity, and the buyout is added to the total before you pay.

05

Can I extend usage rights later?

Yes, by agreeing on a new term and fee with the talent. Ask early in the booking chat, before the current term ends.

06

Is the platform fee added to what the brand pays?

No. The brand pays the listed rate plus the chosen buyout, and the 15% platform fee is deducted from the talent side only.
